4. Cookies
4.1 Our website uses cookies that are technically necessary for the core functionality of the WooCommerce shop system (e.g., keeping track of items in your shopping cart, processing the checkout, or managing user accounts). These cookies do not track your behavior across other websites and do not require prior consent. The legal basis is Art. 6(1)(b) GDPR (performance of a contract) and Art. 6(1)(f) GDPR (legitimate interest).
5. Contact Form
5.1 If you send us inquiries via our contact form, your details from the inquiry form, including the contact details you provided there (such as name, email address, and the content of your message), will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions.
5.2 We do not transfer this data to third parties without your consent. The processing of this data is based on Art. 6(1)(b) GDPR if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. 5.3 The data you enter into the contact form will remain with us until you request its deletion, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after final processing of your inquiry). Mandatory statutory provisions—in particular retention periods—remain unaffected.
6. Payment Processing (myPOS)
6.1 We offer the option to process payment transactions via the payment service provider myPOS. The provider of this service is myPOS World GmbH (or its relevant regional operating entities such as myPOS Europe Ltd.).
6.2 When you select a payment method via myPOS during the checkout process, the data you enter during the order process (including name, billing address, email address, card details, transaction volumes, and total order value) will be transmitted to myPOS via an encrypted connection.
6.3 The transmission of your data to myPOS is based on Art. 6(1)(b) GDPR (processing for the performance of a contract). The transfer is strictly necessary to complete your purchase and authorize the payment securely. myPOS acts as an independent data controller under the GDPR for the purpose of fraud prevention, anti-money laundering regulations (AML), and executing the financial transfer. For more information on how myPOS manages and protects your personal data, please refer to the official myPOS Privacy Policy.
7. Web Analytics (WP Statistics)
7.1 We use the web analysis plugin WP Statistics on our website to statistically analyze user traffic and optimize our web presence. The provider of this plugin is VeronaLabs.
7.2 No Cookies / Cookie-less Analysis: WP Statistics is configured to operate entirely without cookies. No tracking or marketing cookies are stored on your end device for the purpose of analyzing user behavior.
7.3 Local Hosting / No Third-Party Transfer: All analysis data is processed and stored locally within our own secure database on our web server. No data is transferred, disclosed, or sold to the plugin provider or any other third party.
7.4 Anonymization of IP Addresses: Your IP address is anonymized (hashed) immediately during the collection process and before it is saved. It is technically impossible for us to trace the collected statistical data back to a specific, identifiable individual.
7.5 Do Not Track (DNT): We respect the “Do Not Track” (DNT) settings of your web browser. If you have deactivated tracking in your browser settings, WP Statistics will not record your visit.
7.6 The legal basis for this data minimization approach is Art. 6(1)(f) GDPR. We have a legitimate interest in the anonymized analysis of user behavior to improve our services and web presence without infringing on your privacy.
8. Data Collected During Software Activation
When you activate the TSCT software application (either via Online Automated Activation or via Manual Offline Request), certain data is processed to verify your purchase and enforce our 1-PC licensing model.
8.1 Automated Online Activation
8.1.1 When clicking “Activate & Launch Software” inside the application, the software securely transmits the following data to our WooCommerce server via an encrypted connection (HTTPS):
WooCommerce Order ID: To verify that a valid purchase exists in our database.
Billing Email Address: To ensure the person activating the software is the authorized buyer.
Hardware-ID (HWID): A unique 16-character mathematical hash calculated locally based on your PC’s core components (e.g., motherboard/network components). This ID does not contain personal files, names, or identifiable hardware serial numbers.
IP Address: Automatically processed by our web server during the network request.
8.2 Manual Offline Activation
8.2.1 If you use the “Contact Support for Offline Key” option, you voluntarily generate an email template containing your Hardware-ID (HWID). This data is processed by our support team solely to manually generate your offline license key.
9. Purpose and Legal Basis of Software Data Processing
We process your software activation data based on the following legal grounds under the General Data Protection Regulation (GDPR):
9.1 Performance of a Contract (Art. 6(1)(b) GDPR): Processing your Order ID, Email, and HWID is strictly necessary to deliver the digital software license you purchased and to unlock the application for your use.
9.2 Legitimate Interests (Art. 6(1)(f) GDPR): We have a legitimate interest in preventing software piracy, unauthorized license sharing, and ensuring compliance with our 1-PC license limitation.
10. Data Storage, Retention, and Local Device Storage
10.1 Where data is stored: All activation data is safely stored within your secure WooCommerce order database on our web server. No data is shared with third-party tracking companies or external analytics platforms.
10.2 Retention Period: The Hardware-ID remains linked to your order as long as your license is active, or until you request a license transfer or deletion via our support team.
10.3 Local Data Storage on Your Device: Upon successful activation, the TSCT software saves your cryptographic license key locally on your computer inside the Windows Registry (under the path Software\TSCT). This data never leaves your computer after activation. It is used locally to skip the activation window upon subsequent application launches. You can remove this data at any time by uninstalling the application or running our clean-up utility.
11. Your Data Protection Rights (GDPR)
11.1 Under the GDPR, you have the following rights regarding your personal data:
11.2 Right of Access: You can request a copy of the data linked to your order.
11.3 Right to Rectification: You can request to update your email address or transfer your license slot to a new computer (hardware reset).
11.4 Right to Erasure (“Right to be Forgotten”): You can request the complete deletion of your data and order history (note: this will permanently deactivate your software license).
11.5 Right to Restrict Processing / Object: You have the right to object to or restrict the processing of your licensing data.
To exercise any of these rights, please contact us directly at support@365-saint-tropez.com.
12. Security of Your Data
We implement state-of-the-art security measures (including SSL/TLS encryption for all network transmissions) to protect your data from unauthorized access, loss, or alteration.
